Clinical Negligence

Queen Square Chambers’ clinical negligence barristers represent and advise clients across England and Wales in all matters ranging from serious dental problems to injuries resulting from surgery. Our team know the impact of medical treatments going wrong can be devastating, and sometimes the law is the only option people have left.

We are able to assist with every step of the process including Inquest proceedings, from reviewing medical reports through to joint settlement meetings and if necessary to trial.

Success in these cases requires not only a knowledge of the law but also a deep understanding of the medical issues, which is why the department is led by a former consultant cardiologist, Dr David Thomas, who specialises in heart-related matters. The team as a whole has a wealth of experience across many medical areas and appreciate the need to see clients and experts early at a location of your choice.

The barristers are flexible in their approach, happy to discuss cases over the phone and accepting work digitally where possible. This approach continues with regard to fees and the team are always willing to consider a conducting cases under a zero uplift Conditional Fee Agreement and where appropriate they will look to include the Inquest proceedings within that CFA.

The work undertaken by the team is on a national basis and they are always willing to travel to Solicitor’s offices, a client’s home or medical facility to conduct a conference. Members of the team take great care to build empathy with their clients, putting them as ease, while at the same time managing their expectations.

Areas of particular expertise include:

  • Cardio-vascular issues
  • Bowel and bladder surgery
  • Obstetric and gynaecological problems
  • Hip surgery
  • Dental negligence
  • Misdiagnosis
  • Birth complications
  • Fatal accidents
  • Oncology and cancer surgery
  • Orthopaedics
  • Colorectal surgery
  • Ophthalmology – failure to recognise tears and laser surgery complications

Queen Square Chambers also has a specialist Inquest team who in addition to clinical negligence represent families and interested parties in Inquest proceedings as a result of deaths arising in care homes, road traffic accidents, industrial accidents and deaths in police custody.

  • "A great barrister to have on board for high-value claims which also require an understanding approach."
  • "Care cases are a notable strong suit, including matters involving non-accidental injuries, factitious illnesses, incest and sexual abuse."
  • "Queen Square Chambers’ ‘strong employment team’ has ‘skilled, accessible and likeable barristers’ who appear at tribunals across the country, and attract instructions nationally."
The team regularly attend solicitor’s offices to review files, providing initial advice and guidance as well as to provide in-house training. If this would be of interest to you please get in touch
